Argentina: Competition Authority Opens Ex Officio Investigation into Food Delivery Platforms
Bomchil | On March 26, 2026, the Autoridad Nacional de la Competencia (ANC) announced the opening of an ex officio investigation into the market for digital intermediation platforms for the purchase and delivery of restaurant products—commonly referred to as food delivery platforms—in Argentina.
According to the authority, the investigation targets two categories of conduct. First, the potential imposition of most-favored-nation (MFN) clauses, through which platforms may restrict restaurants’ ability to set prices across alternative sales channels. Second, the alleged implementation of exclusivity agreements requiring restaurants to operate solely through a specific platform.
Both practices are preliminarily assessed under Sections 1 and 3 of the Ley 27.442 de Defensa de la Competencia, which prohibit the limitation, restriction, or distortion of competition through the abuse of a dominant position.
The ANC noted that the investigation stems from its monitoring of digital markets and a review of local and international precedents. It also emphasized that the initiation of proceedings does not prejudge the outcome nor imply any attribution of liability.
Under the applicable legal framework, potential infringements may result in fines of up to 30% of annual turnover. No companies were identified in the public announcement.
