Argentina Updates Competition Law Mobile Unit

EY Law |  On January 16, 2026, Resolution No. 6/2026 of the Antitrust Tribunal - Ministry of Economy was published in the Official Gazette of the Argentine Republic. This resolution updates the value of the mobile unit (unidad móvil) as defined in Article 85 of the Antitrust Law No. 27,442 (the "Law").

According to the provisions of the aforementioned article, the value of the mobile unit is to be updated automatically every one (1) year using the Consumer Price Index (CPI) published by INDEC. Consequently, through Resolution 6/2026, the aforementioned amount was updated, setting the value of the mobile unit for the year 2026 at $1,450.05 (one thousand four hundred fifty pesos and five cents).

Accordingly, the new mandatory notification thresholds established by the Law, considering the new value of the mobile units, would be as follows:

  • The total turnover of the group of companies involved must exceed $145,005,000,000 (equivalent to 100,000,000 mobile units) in the country; and
  • The amount of the transaction or the value of the assets located in Argentina that are acquired or transferred must exceed the sum of $29,001,000,000 (equivalent to 20,000,000 mobile units), unless, within the previous 12 months, transactions have been carried out that together exceed that amount, or the sum equivalent to 60,000,000 mobile units, i.e., $87,003,000,000 in the last 36 months.
For its part, the maximum fine for prohibited conduct when it is not possible to determine the business volume of the companies involved (Article 55 of the Law) is updated to $290,010,000,000, equivalent to 200,000,000 mobile units. The daily fine referred to in the same article (which may be up to 750,000 mobile units per day) would reach $1,087,537,500 per day.

Resolution No. 6/2026 enters into force on the day of its publication in the Official Gazette.
