New concession regime for priority electricity projects in Argentina
Bomchil reports that on 29 December 2025, Decree No. 921/25 was published in Argentina’s Official Gazette, establishing a new framework for the execution of expansion works to the electricity transmission system deemed a priority by the Executive Branch.
Under the decree, the projects listed in the Annex to Resolution No. 715/25 of the Ministry of Economy will be carried out pursuant to the public works concession regime set forth in Law No. 17,520, on a no-cost basis, and awarded through national and international public tender procedures. This model seeks to attract private investment to strengthen the country’s strategic energy infrastructure amid increasing demand and structural constraints affecting the system.
The decree assigns a central role to the Secretariat of Energy in implementing the new framework. In particular, it will be responsible for approving the bidding terms and conditions and other tender documentation, calling for and conducting the various stages of the tender process, and awarding and executing the resulting concession agreements.
The measure was adopted within the context of the national energy sector emergency, originally declared by Emergency Decree No. 55/23 and subsequently extended by Emergency Decrees Nos. 1023/24 and 370/25, currently in force until 9 July 2026. In this exceptional context, the Government aims to expedite the execution of projects considered critical to ensuring the security and reliability of the electricity system.
The new regime raises relevant regulatory, contractual and investment considerations for both local and international developers interested in participating in the tenders, as well as for other stakeholders across the energy sector.
