State of Emergency in the Argentina Energy sector extended to 2027

Bomchil | On January 27, 2026, Decree of Necessity and Urgency No. 49/2026 (the " Decree ") was published in the Official Gazette, extending the emergency of the National Energy Sector, originally declared by Decree of Necessity and Urgency No. 55/2023 (extended by Decrees Nos. 1023/2024 and 370/2025), and introducing a transitional maximum price regime for natural gas resulting from the regasification of Liquefied Natural Gas (LNG) during the next two winters.

This time, the extension applies exclusively to the natural gas transport and distribution segments, as well as the actions derived from it, and extends until December 31, 2027.

The Decree also incorporates a transitional pricing regime for imported LNG, applicable to the supply for the next two winter periods. To this end, a maximum sales price is established for the domestic market for gas resulting from LNG regasification. This price may not exceed the international benchmark determined by the Energy Secretariat of the Ministry of Economy (SE), plus an additional value in US dollars per million BTU ( British Thermal Unit ) intended to cover the costs of maritime freight, regasification, storage, marketing, and pipeline transport to the delivery point in Los Cardales, Buenos Aires Province.

The determination of the value in US dollars referred to in the preceding paragraph will be the result of a competitive selection process, conducted in accordance with the guidelines established by the Secretariat of Energy, for the importation of LNG using the available regasification capacity of Energía Argentina Sociedad Anónima (ENARSA). Should this process fail, ENARSA will directly assume the importation, regasification, and marketing of the LNG in the domestic market.

The SE will issue all the clarifying and supplementary regulations that may be pertinent and will give the necessary instructions to ENARSA, in order to fully comply with the provisions of the Decree.
